<p><span style="font-size: 18pt;">進入別人的家中一定要經過屋主的同意才可進入，否則就會冠上無故侵入住宅的罪名，但若是屋主親自開門讓你進入，卻被反咬一口遭到控告，該如何自保脫身呢?</span></p>
<p><span style="font-size: 18pt;">近期我們有一位當事人就被無辜控告侵入住宅，當事人與同社區的住戶Ａ是樓上樓下的鄰居關係，彼此在先前因漏水問題已心生嫌隙。案發當天當事人要出門時，被住戶A的兒子攔下質問如何解決漏水事宜，事後心生不滿的當事人便到住戶A的住所按電鈴，要找住戶A理論並釐清漏水的爭議，詎料雙方在住戶A的住家中發生爭執，當事人離開後就遭到住戶Ａ提告侵入住宅，並聲稱當事人自己打開門闖入他的家中。</span></p>
<p><span style="font-size: 18pt;">當事人深感莫名且無法理解為何無故被冠上罪名，決定尋求 #楊羽萱律師 的專業協助。</span><br />
<span style="font-size: 18pt;">#楊律師 在辯護中替當事人強調:</span><br />
<span style="font-size: 18pt;">1.當事人是為了向告訴人釐清漏水爭議，並非無故侵入他人住宅，澄清進入住戶A住宅的合法性。</span><br />
<span style="font-size: 18pt;">2.被告按門鈴後是由原告親自打開門，代表原告明確同意當事人進入商談。</span><br />
<span style="font-size: 18pt;">3.被告只停留在陽台外推的室內空間，未進入私人臥房空間，也未翻動原告的財務，並無影響原告的居住安寧，進一步證明當事人的行為不構成侵入住宅的故意。</span></p>
<p><span style="font-size: 18pt;">藉由以上關鍵事實， #楊律師 成功地讓檢察官判當事人不起訴處分，還當事人清白!</span></p>
